Electronic Evidencing In India Not Proper

Justice Pradeep Nandarajog of the Delhi High Court has directed all additional session judges of the district courts to be cautious while handling cases related to electronic records. Many trial courts had accepted electronic records merely on the statement of the investigating officer ( IO) without complying with the mandate of Section 65 B of the Evidence Act.

This shows a lack of knowledge about the basics of cyber forensics as well as digital evidencing by Indian courts. There is an emergent need of training of police officers, lawyers, judges, etc in the fields of cyber law and cyber forensics.
